How to submit a takedown notice (17 U.S.C. § 512(c)(3))
For a notice to be effective under the DMCA, it must be a written communication that includes substantially the following:
- A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed (or, if multiple works are covered by a single notice, a representative list).
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material — please include the full URL of the page on this site (e.g.
https://www.mountdiablofamilies.com/events/123). - Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and email address.
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please note: under § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys' fees.
What happens after we receive a notice
When we receive a notice that substantially complies with the requirements above:
- We will remove or disable access to the allegedly infringing material expeditiously — typically within 24 hours.
- We will take reasonable steps to notify the user who submitted the content that we have removed it, and provide them a copy of the notice.
- We will retain a record of the notice and our response.
Counter-notification (17 U.S.C. § 512(g))
If you are a user whose content was removed and you believe the removal was the result of mistake or misidentification, you may submit a counter-notification. To be effective, a counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside of the United States, for any judicial district in which the platform may be found), and that you will accept service of process from the person who provided the original takedown notice, or an agent of that person.

If we receive a valid counter-notification, we will forward it to the complaining party. Unless the complaining party files an action seeking a court order against you within 10–14 business days of receiving the counter-notification, we may restore the removed material.
Repeat infringer policy
In accordance with § 512(i), Mount Diablo Families terminates the access of users who are determined to be repeat infringers of copyright. Because this site does not require user accounts, “termination” means we will block further submissions from any submitter (by name, email if provided, or IP address) who has been the subject of multiple valid takedown notices, and we will treat any future content from that submitter as ineligible for inclusion.
We may also remove or block content at our discretion when we receive credible reports of infringement, even outside the formal DMCA notice process.
